1. Purpose of this policy
BergHotel places particular importance on protecting the privacy and personal data of its guests and visitors.
The purpose of this policy is to explain transparently what personal data may be collected when using the BergHotel website, why it is collected, how it is used, and what rights data subjects have.
Personal data processing is carried out in accordance with Regulation (EU) 2016/679 of April 27, 2016, known as the General Data Protection Regulation (“GDPR”), as well as the amended French Data Protection Act.

The CNIL requires in particular that users be able to identify the data controller, the purposes, legal bases, recipients, and retention periods for data.
3. Personal data that may be collected
Depending on the services used, BergHotel may process the following categories of data in particular:
Identification and contact data:
last name, first name, email address, phone number and, when necessary, postal address.
Booking-related data:
stay dates, room category, number of adults and children, selected services, special requests, booking number or reference.
Billing and payment data:
information necessary for billing, payment history, and payment method information.
Bank details may be processed by the payment and booking service providers used by BergHotel. BergHotel does not necessarily retain complete bank card data itself.
Data relating to communications with the establishment:
content of requests submitted by form, email, or phone and responses provided.
Technical data:
IP address, browser and device information, technical logs, pages viewed, and information relating to site usage when such data is necessary for its operation or when the user has consented to the relevant trackers.
BergHotel strives to limit the data collected to that necessary for the purposes pursued, in accordance with the principle of data minimization.

Personal data may be used in particular for the following processing activities:

No data collected via a contact form may be automatically used to send a newsletter if the user has not been properly informed and the required consent has not been obtained.
5. Booking with Amenitiz
The BergHotel website allows you to search for accommodation availability by entering in particular:
- arrival date;
- departure date;
- number of adults;
- number of children.
When the user clicks the button to search for availability, they are redirected to the booking engine operated by Amenitiz.
The data entered and communicated during the completion of the booking are then likely to be processed by Amenitiz as part of the provision of its services to BergHotel.
The applicable processing conditions are specified in the data protection information made available during the booking process.
BergHotel remains responsible for the processing for which it determines the purposes and means, in accordance with applicable regulations.
6. Data recipients
Personal data is accessible only to individuals and organizations who need it to carry out their duties.
This may notably include:
- authorized BergHotel staff;
- the provider in charge of the booking system;
- payment service providers;
- technical and hosting providers;
- providers in charge of site maintenance;
- the establishment’s professional advisors when necessary;
- administrative or judicial authorities when required by law.
Providers to whom personal data is entrusted may only use it within the framework of the tasks assigned to them, subject to their own potential responsibilities under applicable regulations.
7. Retention period
Personal data is only kept for the duration necessary to achieve the purposes for which it was collected, increased when necessary by legal retention or statutory limitation periods.
As an indication:
Contact requests: duration necessary to process the request, then possible archiving for a period proportionate to its nature.
Data relating to bookings and stays: for the duration necessary to execute the booking, then for the applicable legal periods.
Accounting documents and invoices: for the applicable legal retention period.
Commercial prospecting: for the duration authorized by regulations or until consent is withdrawn when processing is based on it.
Cookies and trackers: according to their nature and within the limits provided by applicable regulations.
Data can then be deleted or anonymized.
8. Data transfer outside the European Union
Certain technical providers used by BergHotel may be established or process data outside the European Economic Area.
When such a transfer occurs, BergHotel ensures, where it is its responsibility, that it is based on a mechanism provided for by the GDPR, notably an adequacy decision by the European Commission or appropriate safeguards such as standard contractual clauses.

BergHotel implements appropriate technical and organizational measures to protect personal data against, in particular:

However, as no computer system can guarantee absolute security, BergHotel adapts its protection measures to identified risks and technological developments.
10. Your rights
In accordance with applicable regulations, any data subject may have, depending on the processing concerned:
- a right of access to their data;
- a right to rectification of inaccurate data;
- a right to erasure in cases provided for by regulations;
- a right to restriction of processing;
- a right to object when processing is based notably on legitimate interest;
- a right to portability when legal conditions are met;
- the right to withdraw consent at any time when processing is based on it.
The withdrawal of consent does not call into question the lawfulness of the processing carried out before this withdrawal.

12. What is a cookie?
A cookie is a small file or tracker likely to be saved or read on a user’s terminal when consulting a website.
Cookies can notably enable the technical operation of the site, the memorization of certain preferences, the measurement of traffic, or the use of services offered by third parties.
Not all cookies require consent. Trackers strictly necessary for the operation of the service may notably be exempted; advertising, social, and more generally those that are not strictly necessary require, in principle, prior consent.

When the user leaves the BergHotel site to access the Amenitiz booking engine, cookies and other trackers may be used by the booking service.
Information relating to the trackers used in this environment is communicated according to the terms provided by the relevant service provider.
17. Managing your consent
During their first visit, the user is informed of the possible use of cookies requiring their consent.
They must be able to:
Accept all — authorize cookies subject to consent;
Reject all — continue their navigation without accepting these cookies;
Customize — choose the categories of cookies they wish to authorize.
Continued navigation does not constitute valid consent and no tracker subject to consent must be placed before a positive action by the user.
The “Reject all” button must be as easily accessible as “Accept all”. The CNIL confirmed this again in its FAQ updated in 2026 and also sanctions misleading presentations artificially favoring acceptance.
18. Modifying or withdrawing your consent
The user can modify their preferences or withdraw their consent at any time.

Withdrawing consent must be as simple as granting it. The CNIL therefore recommends providing a visible mechanism accessible from all pages.
